North San Juan man accused of rape

A North San Juan man was arrested Sunday evening after a woman reported being raped the night before at a party. Witnesses reportedly had said the suspect was at the crime scene.

David Forkner, 34, told officers he had sex with the woman, but that it was consensual, Sheriff’s Sgt. Jeff Powell said.

The woman told investigators she went to a party late Saturday night and drank too much, so she went into a bedroom to get some sleep. That was the last thing the woman remembered from that night, Powell said.

The next morning, the woman woke up with a bite mark on her neck and was in pain. She was taken to the hospital where doctors determined she did have sex the night before.

Witnesses at the party told investigators that Forkner walked out of the bedroom the woman was in.

The next day, Forkner volunteered to speak with officers and told them he did have sex with the woman – but that it was not a rape.

Forkner faces charges of rape and violating probation. He has been arrested numerous times in the past, including in February, when he was taken into custody for assault with a deadly weapon and malicious mischief.
