A story on possible death penalty cases in recent Nevada County history might have been misleading about the reason the death penalty has not been sought for murder suspect Scott Krause. While Krause’s mental state at the time his alleged crimes were committed may have been in question from the time of the arrest, it was not until several months into the court case that he pleaded “not guilty by reason of insanity,” by which time the district attorney had decided not to seek the death penalty.



One of the specific reasons the death penalty has not been sought is Krause’s criminal record, which lacks convictions in any serious felonies.
