Supes may throw out Dark Horse ballots

Unsealed ballots submitted by Dark Horse subdivision homeowners to apparently reject a sewer rate increase could be thrown out by the Nevada County Supervisors with an order for a revote.

Board members this morning said they were uncomfortable accepting the open ballots and want to know if they can legally consider them at all. County Counsel Rob Shulman said he would let them know when the board reconvenes at 1:45 p.m.

“I think you have the power to order a revote, but I’ll have to check,” Shulman said. “Somebody could say we have no proof how they voted.”

The County Counsel also said, “State law wants ballots under wraps until they are counted.” Shulman said the homeowners thought they were conducting the mail ballot election legally and he did not think the ballots were tainted.

Dark Horse Homeowners Association Vice-President Eric Harvey said none of the ballots were tampered with. The homeowners simply hand-delivered the unsealed ballots to the county because they feared they would be lost in the mail, he said.

But just the perception of a tainted election was enough to cause the board to unanimously reject the ballots and call a revote, pending Shulman’s probe into the matter during the lunch hour.
