Regarding Meadow Vista asphalt plant

At issue is the failure of local government to review the legitimacy of the 35-year-old continual use permit.

The permit, issued prior to the California Environmental Quality Act, would not pass environmental scrutiny today. It allows for two asphalt plant locations, one next to the Bear River and one 600 feet away. Both locations are within a 100-year flood plain and should be of concern to government officials on an ecological and community level.

The permit places no time, asphalt production, noise, dust or truck emission limitations. It was issued in 1971 without regard to future changes in the area (i.e., increased residential population and impact on the Bear River). It poses such a potential health risk to the community that Richard Burton, county health physician, wrote a cautionary letter to the county when Teichert Construction was ready to put in a temporary asphalt plant in 2005.



Both the U.S. Constitution and the California Constitution allow local government to exercise its police power to remedy health, safety and welfare concerns. County government has a duty to review LDA-786 for negative impacts on the environment. The focus of local government should be on the community, not just the economic impact of the affected property owner.
