Robert Taylor sentencing set for Friday; judge rules against Taylor’s motion for new trial

Robert Lewis Taylor, convicted by a Nevada County jury of lewd acts against a child, failed in his Tuesday attempt to get a new trial, prosecutors said.

Taylor, 52, remains scheduled for a Friday sentencing on six counts of making lewd acts against a child.

Convicted in May, Taylor was acquitted on a seventh count. Jurors reached no decision on five other charges.

According to District Attorney Cliff Newell, probation reports recommend a sentence of 90 years to life. Judge Robert Tamietti, however, isn’t bound by that recommendation.

Taylor argued that juror misconduct in his case warranted a new trial. In court documents he claimed that one juror, who said she was molested as a child, improperly discussed her experiences during deliberations.

Prosecutors said that juror’s personal opinions didn’t rise to the level of misconduct.

“In the world of a jury, once one is picked and set for a case, they often become a living, breathing organism,” Newell said.

Juries aren’t perfect, though barring an egregious breach of conduct, their verdicts should remain unchanged, he added.
