Marijuana legislation moves to full Assembly for vote

Legislation that would remove a deadline for local governments to enact their own marijuana regulations cleared another hurdle Wednesday, with the measure headed to the full Assembly for a final vote today.

A successful vote by the Assembly today on AB 21 will send the bill to the governor’s desk.

The state Senate on Monday approved the bill, sending it to the state Assembly. On Wednesday the bill unanimously passed the Assembly’s Local Government Committee. It’s now scheduled for the full Assembly’s 9 a.m. session today.



Existing law states that local governments have until March 1 to pass their own marijuana cultivation ordinances. If they fail to have a local ordinance in place, the state would implement its own regulations.

AB 21 would remove the March 1 deadline, giving local governments more time to develop their own ordinances.




Sheriff Keith Royal on Jan. 12 pointed to the deadline as one reason the Nevada County Board of Supervisors should move quickly on restricting all outdoor grows and limit indoor grows to 12 plants. The board later that day immediately implemented the ban.

The board also sent the issue to the voters, who will decide in June whether to uphold the new restrictions.
