Bikers busted for drinking

Three men riding together on motorcycles, making an apparent tour of area bars, were arrested on suspicion of drunken driving near the Nevada County line, California Highway Patrol officials reported Monday.

CHP Officer Earl Cummins said an officer patrolling near the intersection of Highway 20 and Penn Valley Drive at approximately 6 p.m. Saturday saw the men drive by westbound on Highway 20, then heard the motorcycles accelerate when they were out of his sight.

Cummins radioed ahead to officer Todd Labadie, stationed near Melody Road, who clocked the men on his radar gun at 70 miles per hour.



Both officers stopped the men and reported smelling alcohol on their breath. Two of the men allegedly failed field sobriety tests, and all three failed breathalyzer tests.

“They were over the legal limit,” Cummins said. “They had been hitting bars in North San Juan, Nevada City, Grass Valley and they were headed to Marysville.”




Cary Schwartz Cary, 47, of Oroville, Terrance Cross, 53, of Berry Creek and Carlos Santacruz, 61, of Loma Rica were all booked into Wayne Brown Correctional Facility on suspicion of drunken driving. Cross was also booked on possession of less than an ounce of marijuana.

A fourth man riding with the group was not over the legal blood alcohol limit and was released.
