Man offered plea deal in sex case

A 20-year-old Grass Valley man charged with unlawful sexual contact with a 13-year-old girl has been offered a plea deal that would send him to prison for six years.

Danial Burley was arrested in March and charged with two counts of lewd acts on a child and one count of oral copulation of a child younger than 14.

He had pleaded not guilty. On Thursday, Burley was in Nevada County Superior Court for a felony conference; a preliminary hearing into the evidence was scheduled for Aug. 21.



Deputy District Attorney Jennifer Ow told Judge Linda Sloven that she had tendered an offer to Burley, which would remain open until the preliminary hearing date.

Burley would have to plead no contest to one count of lewd act on a child with a special allegation of great bodily injury due to pregnancy, Ow said. The sentence would be six years in state prison, to be served with only 15 percent time credit for good behavior.




Ow noted this would be considered a violent and strike felony. She also noted that if the case proceeds to the August hearing, she will be adding more criminal charges.
