Bush lost, or afraid?

President Bush stated, in the Friday night town hall debate, that he would not appoint a justice to the Supreme Court that would be in favor of Dred Scott. From this one can conclude one of the following:

– The president is trying to win the votes of runaway slaves.

– The president was speaking in a code used by the religious right-wing where the Dred Scott decision is the same as Roe v. Wade. Is G.W. hopelessly lost in the 19th century or afraid to clearly speak his mind?
