Banner Mountain homeowners sue NID over pipeline plan

Five years worth of negotiation apparently did not satisfy Banner Mountain homeowners faced with the construction of a major water pipeline.

Friday, the homeowners sued the Nevada Irrigation District, saying the Banner/Cascade Pipeline Project’s environmental report does not protect their wells

or ensure NID will supply them water in the future. The lawsuit filed in Nevada County



Superior Court by Attorney Marsha Burch also says the report does not protect property rights or the aesthetics of the neighborhood.

The $36 million, four-foot wide, raw water pipeline approved by the NID board in mid-February was conceived to replace two old NID canals and to provide a better delivery system for area growth.




The suit filed for the Banner Mountain Homeowners Association Pipeline Committee, “Is a challenge to the project approval on the grounds the environmental review was insufficient,” Burch said. “We’re seeking adequate review,” before the project is started.

The pipeline would go from Banner Mountain above Nevada City to the E. George Water Treatment Plant above Grass Valley.

The plan includes a treated water line to provide service to those whose wells along the pipeline might be impacted by the project. However, the suit says NID’s environmental report leaves it open for NID to scrap the treated water line at a later date.

A call to NID was not returned late Friday.
