Yelling man arrested on burglary, drug charges

Nevada City Police officers responding to a report of a man yelling in a store bathroom for a half-hour ended up arresting him after he reportedly was found with drugs and stolen jewelry.

An employee of SPD Market on Zion Street called for service at about 4 p.m. Monday to report the man, who was identified as Brendan Connor Smith, 20. Officers responded and were contacted by an employee, who said the man had left the store and was walking toward Argall Way.

The man was located and appeared to be under the influence of a controlled substance, said Officer Scott Goin.

Smith was searched and he was reportedly found to have several prescription narcotics, as well as a hypodermic needle.

Officers then found three small baggies on Smith that contained a number of items of gold jewelry, Goin said. Working with the Nevada County Sheriff's Office, it was determined the items had come from a residence in the county belonging to Smith's mother, who had reported a burglary earlier in the day.

Smith had gone to his mother's house in the 10000 block of Boulder Street at about 2 a.m., asking if he could stay, said Sheriff Keith Royal. He left at about 6 a.m. and his mother left around 6:45 a.m., returning to her residence at about noon.

When she got home, she discovered that a safe in her bedroom had been broken into, with a pickax and a screwdriver lying on the floor nearby.

Approximately 36 pieces of jewelry were missing, including rings, chains and a gold watch, worth several thousand dollars, the woman told deputies. She also reported that several Oxycontin and hydrocodone pills were missing.

Smith told deputies that he knew his mother's schedule and had gone back to the residence after she left, crawling through an open window, Royal said.

Smith was booked into the Nevada County Jail on suspicion of second-degree burglary, being under the influence of a controlled substance, possession of a controlled substance, possession of drug paraphernalia and possession of stolen property. He was being held in lieu of $52,000 bail.
