Nevada City men arrested for allegedly shipping marijuana

A year and a half after their arrest, charges finally have been filed against two Nevada City men who allegedly shipped marijuana to North Carolina.
Gavin Alan Gryte, 37, and Hans Kubitschek, 33, were arrested in May 2011 after allegedly shipping marijuana to North Carolina.
A package containing marijuana was intercepted by detectives in New Hanover County, N.C., and their investigation allegedly led Nevada County Sheriff's deputies back to the two men.
Local detectives arrested Gryte on suspicion of transporting marijuana for sale at his residence after they allegedly located a substantial amount of packaging material.
Sheriff's deputies also searched Kubitschek's residence, where they allegedly found a "sophisticated grow room" with more than 100 plants and packaging material.
Kubitschek was arrested on suspicion of cultivating marijuana, possession for sale and transportation for sale, as well as violating probation.
He had been on probation for a 2009 arrest in which Nevada County sheriff's deputies uncovered a large amount of weapons, as well as marijuana; he eventually pleaded no contest to a misdemeanor on a weapons charge and was sentenced to three years summary probation with search and seizure terms.
Nevada County Deputy District Attorney Jim Phillips said he had delayed filing charges because he was waiting for the authorities in North Carolina to decide if they were going to prosecute the case from their end.
"We got tired of waiting and we eventually just went ahead and filed the case," he said.
But Phillips only filed initially against Kubitschek because he believed Gryte was deceased, he said. But he has now filed an amended complaint, charging both men with cultivating marijuana, possession of marijuana for sale and transportation for sale.
Kubitschek was in Nevada County Superior Court Thursday but deferred entering a plea. He is set to return Dec. 27; it was not clear when Gryte would be arraigned on the charges.
