Eric Douglas Morton, 25, surrendered at Wayne Brown Correctional Facility on Sunday to begin serving a 120-day sentence. He is eligible to apply for alternative sentencing after 30 days.
Morton had been charged with one count of oral copulation with a person incapable of consent, after Nevada County Superior Court Judge Robert Tamietti did not find sufficient evidence to try him on counts of sexual penetration with a foreign object and sexual battery.
A 24-year-old Rocklin woman identified only as Jane Doe No. 1 had testified she became "severely intoxicated" at an Auburn bar in November 2009 and had blacked out, waking to find Morton allegedly performing oral intercourse on her at his home. There was only circumstantial evidence of injury, Tamietti ruled.
Tamietti also had dismissed a count of sexual battery involving a second alleged victim.
Morton accepted a plea agreement, pleading no contest to false imprisonment. He was sentenced by Judge Candace Heidelberger to four months in jail and three years supervised probation.
