DA allegedly told couple, 'seig heil,' before bar fight

The alleged victims in an altercation at a Downieville bar two weekends ago provided more details of the incident Tuesday, charging that the county district attorney made an offensive remark and gesture to them before the allegedly unprovoked assault.

District Attorney Larry Allen was on the deck of the bar when he allegedly “beat on his chest, raised his arm like Adolf Hitler and hollered ‘sig heil (sic), sig heil, sig heil’” to Julie Wussow, of Nevada City, and her boyfriend, Mike Allgeier, according to a written statement that Wussow provided to the Sierra County Sheriff’s Office.

Following Allen’s alleged gestures, Wussow and Allgeier walked out to the deck of the bar and allegedly asked Allen for an apology.

Wussow charged she and Allgeier were then assaulted, as Allen swung his elbows at Allgeier. Wussow said she was injured in the incident.

“Mike was hit, and I was slammed into the outer brick wall of the St. Charles Place, and my right foot was twisted in to one of the outdoor iron tables, as I hit the ground,” Wussow wrote in her complaint.

Wussow said she suffered a broken foot in the alleged incident.

Allen, a two-term district attorney, confirmed he was at the bar that night, at about 12:30 a.m. on Aug. 24, but he has declined numerous times to describe his involvement in the alleged incident.

No arrests have been made, and the Sheriff’s Office has forwarded the case to the state Department of Justice for investigation to help avoid any possible conflict of interest.

The Sheriff’s Office has declined The Union’s request to see the incident report, according to a letter dated Aug. 28 and signed by Sheriff John Evans. The letter from Evans, received at The Union’s offices on Tuesday, states that “there are no arrest records pertaining to this matter” and reiterates that Wussow’s complaint has been forwarded to the state Justice Department.

The Justice Department does not comment on pending investigations, a spokeswoman said.

The day began when Allgeier, a member of E Clampus Vitus William Downie chapter, came to the bar to work as the group’s libationist, or bartender, at 8 a.m, according to Wussow’s statement.

Wussow’s statement said that her boyfriend worked the bar until 6 p.m., ate dinner and attended a street dance until midnight.

It indicates that the couple ended up at the deck of the bar, where Allen made his alleged comments.

After the alleged assault, Wussow said that Allen attempted to apologize to her after she fell, before his friends escorted him from the bar. Wussow said Allen later spent the night in a local motel.

Wussow said she suffered lacerations and bruises to her right arm, and her right foot swelled up. She said the Sheriff’s Office took photos of her arm.

She walked on the foot the following day, she said, until she went to the Yuba Docs clinic in Grass Valley and discovered she had broken bones in her foot. She said her walking cast, a big plastic boot, will remain on for a month.

“This was an unprovoked hate crime, and I was injured,” Wussow wrote in her statement to the Sheriff’s Office.

Wussow wore a walking cast on her foot Tuesday.

The Justice Department has taken footage from the cameras inside the bar, said bar owner Jim Roos, who was at the bar that night.

Roos said the alleged incident described by Wussow was exaggerated.

Roos was sitting at a table at the end of the deck of the bar when the alleged altercation took place. He said he was sitting with his girlfriend, as well as Larry Allen, and Allen’s wife. He said that everyone in the group, including Allen, was drinking.

“Nobody was falling-down drunk or anything,” said Roos, who added he has been interviewed by Department of Justice investigators.

Roos admitted that Allen pushed his way through the crowd to get to Allgeier, but that was about it.

“It was no more than that. There was no fight, no words at all.” Roos said the entire altercation lasted less than three minutes.

Roos said the “seig heil” reference was nothing more than a jab at Allgeier’s political leanings and stemmed from a conversation they had earlier. Wussow said she was at the bar that night wearing a shirt supporting Republican presidential nominee John McCain.

Allen is a registered Democrat.

Roos said he believes Allen didn’t mean to harm anyone when he made his way through the crowd.

“I am absolutely sure that Larry wouldn’t take on anyone,” Roos said. “He’s a very mellow man. I saw him push by Mike, but he certainly wasn’t swinging. I’m certain of that.”

Roos said the cameras will show that.

“There was no attack,” said Roos, who has owned the bar for many years. “At the very least, (Allen) should not have pushed through the way he did. It was not an altercation. The whole event took place in less than half a second. I don’t think Larry knew what happened until he went out the door.

“If anybody’s going to look bad on the tape, it’s going to be Mike,” Roos alleged.

Wussow and Allgeier said they haven’t been contacted by the Justice Department.

They came forward with their written statement because an article in the Mountain Messenger, a weekly newspaper in Downieville, and a letter to the editor in The Union unfairly downplayed the incident, Allgeier said.

Roos confirmed Tuesday that he has a financial interest in The Mountain Messenger.

Allgeier said he has nothing against the Clampers, and the altercation has nothing to do with them. Allgeier said he is proud to be a Clamper and emphasized their fundraisers for the region.

But he said he wanted to set the record straight about the alleged altercation and the DA’s actions.

The Nevada City couple haven’t returned to Downieville, where Wussow was recently a participant in the Downieville Days parade over the summer.

“This is a town and a group of people that meant the world to me,” she said. “These people are our friends, and now they’re attacking us.”
