Judge denies lawsuit dismissal
A Placer County judge ruled against dismissing a lawsuit filed by Meadow Vista Protection against Chevreaux Aggregates, Inc., court documents show. A trial date is set for November.
The lawsuit, filed by a group of residents in Meadow Vista and surrounding communities in July 2006, contends that Chevreaux violated the conditions of its permit for operating an asphalt plant at its quarry in Meadow Vista.
In his decision, Judge Charles D. Wachob denied Chevreaux's argument that a trial was unnecessary because Chevreaux's permits, dating back to 1946, are protected by the 1975 California Surface Mining and Reclamation Act.
In the same ruling, dated last Tuesday, Wachob denied Meadow Vista Protection's request for a summary adjudication on Chevreaux's use permit to operate an asphalt plant.
Wachob also declined to consider a last-minute letter written by the Placer County planning director stating that Chevreaux's permit was valid because it was not submitted in a timely fashion.
